I have over 14 years experience defending foreclosures. If there is a way for you to avoid being foreclosed on, I will find it. The bank has an attorney and so should you. You needn't worry once I am your foreclosure lawyer.
Foreclosure is a legal issue in which the bank is attempting to collect on a debt. That debt is in the form of a note and mortgage that you signed at the closing. You either purchased or refinanced a home or other real estate property or cooperative apartment. The note is your personal promise to pay. The mortgage is the lien against the property that is the collateral behind your promise to pay.
If and when you are late with your payments, then the bank can and will start a Foreclosure Proceeding. You will get served with a legal summons and complaint from the bank's attorneys who concentrate in foreclosure. You have either 20, 30 or 40 days to answer the complaint. You need to have your foreclosure attorney in Florida or New York answer the complaint. Most importantly, in any foreclosure proceeding, you must answer the complaint or you will be held in "default". Once defaulted, the bank is able to ask the court for the relief demanded in the complaint, which is to foreclose on the home and sell it at public auction. If you are served with a foreclosure summons and complaint you must answer it.
It is very important that you seek the help of an experienced attorney. After all, why would you go to a source with no credentials for this help? Costs? My fees are very reasonable and, in the long run, will be less than what you would pay these fly-by-night operations or with no experience. With Johnny the Lawyer, you will get true foreclosure help and will never be scammed by the same people who put you in this position.
In my over 14 years of successful experience with New York and Florida foreclosure laws, I have developed a system and handle the foreclosure in two ways:
· First, I legally defend the foreclosure. This is lawyer vs. lawyer. There might be a service issue-maybe you are the victim of fraud; maybe the bank violated a Federal law such as TILA or HUD; or maybe the bank's representative misrepresented the facts.
· Second, I will negotiate directly with the bank. This is lawyer vs. bank. (See below for the possible negotiated alternatives to having your property foreclosed.)
It is urgentthat if you face such distress, insist on being provided with verification of valid licenses in your state and practical experience in all aspects of foreclosure defense. At the law offices of John Mangelli, we are licensed in New York and Florida. We utilize all aspects of defense such as forbearance agreements, loan modification, deed in lieu of foreclosure, short sales bankruptcy and many other legal strategies to help you find a foreclosure solution. I have years of experience litigating with lending institutions and will personally explore any and all possibilities for the homeowners to remain in their homes as long as it is legally possible. Foreclosing need not be your fate!
Beware of any person or organization that claims they can help you-but is not an attorney. Ask them if they are licensed or regulated in any way. If they are not, then do not deal with them. If they say yes, determine the following:
· By which agency are they regulated
· Who oversees their organization
· How long have they been with the company
· The names of any attorneys on staff
· If the attorneys can be verified by the state's bar association
If they are foreclosure attorneys in Florida or New York, ask how much experience they have with foreclosures. I have found that many companies are completely misrepresenting their ability and experience and claim they have attorneys on staff who actually have no experience or credentials.
· Summons and Complaint
· Order of Reference
· Oath and Report
· Judgment of Foreclosure
· Sale of Property
Don't get stuck, I can help! I have helped many people and have many stories to tell about how I have saved peoples' homes.
Mortgage Modification: First you must answer the complaint. The answer is your legal defense to the foreclosure. In some situations the bank works to foreclose on your home and take your equity. Requesting a change to your repayment obligations may be an available alternative. Click the link to learn more.
Eviction Defense: Even if all your efforts have failed to prevent the bank from foreclosing, we can help you buy more time to move from the bank or new owners. Faced with eviction you definitely should contact me with the details so we can determine what to do. I can get you the maximum amount of time allowed according to the foreclosure laws in Florida and New York.
