I have over 12 years experience defending foreclosures. If there is a way for you to avoid being foreclosed on, I will find it. The bank has an attorney and so should you. You needn't worry once I am your foreclosure lawyer.
Foreclosure is a legal issue in which the bank is attempting to collect on a debt. That debt is in the form of a note and mortgage that you signed at the closing. You either purchased or refinanced a home or other real estate property or cooperative apartment. The note is your personal promise to pay. The mortgage is the lien against the property that is the collateral behind your promise to pay.
If and when you are late with your payments, then the bank can and will start a Foreclosure Proceeding. You will get served with a legal summons and complaint from the bank's attorneys who specialize in foreclosure. You have either 20, 30 or 40 days to answer the complaint. You need to have your foreclosure attorney in Florida or New York answer the complaint. Most importantly, in any foreclosure proceeding, you must answer the complaint or you will be held in "default". Once defaulted, the bank is able to ask the court for the relief demanded in the complaint, which is to foreclose on the home and sell it at public auction. If you are served with a foreclosure summons and complaint you must answer it.
It is very important that you seek the help of an experienced attorney. After all, why would you go to a source with no credentials for this help? Costs? In my over 12 years of successful experience with New York and Florida foreclosure laws, I have developed a system and handle the foreclosure in two ways:

Beware of any person or organization that claims they can help you-but is not an attorney. Ask them if they are licensed or regulated in any way. If they are not, then do not deal with them. If they say yes, determine the following:
· By which agency are they regulated · Who oversees their organization · How long have they been with the company · The names of any attorneys on staff · If the attorneys can be verified by the state's bar association
If they are foreclosure attorneys in Florida or New York, ask how much experience they have with foreclosures. I have found that many companies are completely misrepresenting their ability and experience and claim they have attorneys on staff who actually have no experience or credentials.
